Who can obtain copyrights?
Generally anybody who creates a work that is in a tangible form can be the creator of the copyright. Copyright’s that are created after 1978 are automatically protected under the U.S. Copyright law. The created work need not be published to maintain copyrights. Also, the work need not be registered however there are advantages to registering the work with the U.S. Copyright office.
The creator of the work is the only person who can have the rights to copyright protection. The copyright can be transferred, sold or licensed to another person or company.
If the work was created in a “work for hire” scenario, the owner and holder of the copyright is the organization that commission the work to be created. The creator of the work has in essence given up any rights to the created work since it was created for a “work for hire”.
Joint parties can also be the holder of the copyright. If multiple people partnered in the creation of a work, both parties have the right of copyright. There are different laws for the duration of the copyright compared to single owners but the protection is generally the same.
